OrcaDeal is owned and operated by SAMS NEW DREAMS INC., a Texas corporation.

Throughout these Terms, “OrcaDeal,” “we,” “us,” and “our” refer to SAMS NEW DREAMS INC. By accessing or using our website or Services, creating an account, or placing an order, you agree to be bound by these Terms of Service. Please read these Terms carefully before using our website or Services.

🛒 1. Online Store Terms

You must be at least 13 years old to use our website. If you are under the age of majority in your jurisdiction, you may use the Services or make purchases only with the involvement and consent of a parent or legal guardian.  You may not use our Services for any illegal or unauthorized purpose or violate any applicable laws while using the website.  Violations may result in suspension or termination of access.

We may refuse or limit service, orders, or transactions where permitted by law, including to prevent fraud, abuse, or violations of these Terms.  Information submitted through the Services may be transmitted over various networks and processed by Shopify and other authorized service providers as necessary to operate the Services. Payment information is handled through Shopify and authorized payment providers using applicable security measures. You agree not to reproduce, duplicate, copy, sell, or exploit any part of the Services without our written permission.

📚 3. Accuracy, Completeness & Timeliness of Information

We make reasonable efforts to provide accurate information, but the website may contain inaccuracies or outdated content.  Product details, specifications, colors, images, and pricing may be provided by suppliers or fulfillment partners.  We may correct or update information at any time.

📦 4. Products & Services

Some products or Services may be available exclusively online.  Products may have limited quantities and are subject to our Return & Refund Policy.  We attempt to display product images and colors accurately, but we cannot guarantee exact representation on every device.  Packaging, labeling, or presentation may vary when manufacturers update products.  We may limit quantities, discontinue items, or modify offerings where appropriate.  Certain products may be subject to:

• Supplier restrictions
• Inventory limitations
• Shipping restrictions
• Geographic limitations
• Manufacturer requirements
• Applicable laws

💲 5. Pricing & Promotions

Prices may change without notice where permitted by law.  Promotions, discount codes, and sales may include eligibility requirements, expiration dates, exclusions, or quantity limits.  Unless stated otherwise, promotions cannot be combined.  If an obvious pricing or promotional error occurs, we may correct the error and cancel or adjust affected orders where permitted.

🧾 6. Billing & Account Information

You agree to provide current, complete, and accurate purchase and account information.  You must update your email, billing, shipping, and account details when necessary.  We may refuse or cancel orders involving:

• Suspected fraud
• Incorrect pricing
• Inventory issues
• Shipping restrictions
• Invalid customer information
• Payment authorization failures
• Supplier limitations
• Violations of these Terms

If OrcaDeal cancels an order or an item after payment has been successfully collected, the amount paid for the canceled order or item will be refunded to the original payment method, subject to applicable law and payment-provider processing times.

🏭 7. Suppliers, Fulfillment Partners & Inventory

OrcaDeal works with multiple suppliers and fulfillment partners.  Inventory may change without notice, including after an order is placed.  If an item becomes unavailable after an order is placed, OrcaDeal may cancel the affected item. If payment has already been collected for that item, the amount paid for the canceled item will be refunded to the original payment method, subject to applicable law and payment-provider processing times.  Orders containing items from multiple suppliers may:

• Ship separately
• Have different tracking numbers
• Arrive on different dates
• Ship from different locations

This does not indicate an incomplete order.

🚚 8. Shipping & Delivery

Shipping estimates are estimates, not guarantees.  Delivery times may vary due to carrier delays, weather, supplier processing, holidays, incorrect addresses, or other factors beyond our control.  Customers must provide accurate shipping information.  Additional terms are described in our Shipping Policy.

🔄 9. Returns, Refunds & Cancellations

Returns, refunds, damaged items, incorrect items, and cancellations are governed by our Return & Refund Policy.  Return authorization may be required before sending items back.  Orders may transmit quickly to suppliers, so cancellation is not guaranteed once processing begins.

💍 10. Jewelry & Product Care

Jewelry and other products may naturally experience wear, discoloration, scratches, or tarnishing over time.  Customers should follow product‑specific care instructions.  Materials, gemstones, finishes, and other characteristics are based on supplier information unless stated otherwise.  For additional information about jewelry care, please visit our FAQ Page.

We may provide access to third‑party tools, websites, platforms, or services.  These services operate under their own terms and privacy policies.  We do not control third‑party websites and are not responsible for their content or practices.  Review third‑party terms before use.

💬 12. User Comments, Reviews & Feedback

By submitting reviews, comments, photos, or feedback, you represent that you have the right to submit such content.  Your content must not:

• Violate laws
• Infringe intellectual property
• Contain abusive or defamatory material
• Contain malware
• Misrepresent your identity

We may use or publish customer reviews as permitted by law and our Privacy Policy.  We may remove content that violates these Terms.

Nothing in this section limits any mandatory consumer protection rights or other rights that cannot legally be excluded under the laws applicable to you.
